NA 46 rigging case, order to submit Form 45, 46, 47 to Returning Officer

Islamabad: The High Court has ordered the returning officer to submit forms 45, 46, and 47 in the NA 46 fraud case.

Before Election Tribunal Justice Tariq Mahmood Jahangiri, a hearing was held on the appeal of PTI-backed candidate Aamir Mughal against alleged rigging in Constituency NA-46 of Islamabad, in which Legislature MNA Anjum Aqeel Khan appeared with his lawyer.

During the hearing, the election commission counsel told the court that the copies of the petitions were not found, we have submitted forms 45, 46, and 47, on which the court directed the petitioner to provide the copies to the election commission. The lawyer of the returning officer told the court that I had a party yesterday and that I would give some time to answer, on which the court ordered the returning officer to submit forms 45, 46, and 47.

A petition was filed in the court by Legislature MNA Anjum Aqeel Khan, in which it was held that Aamir Mughal’s petition was not admissible as the requirements were not met. Aamir Mughal’s lawyer was instructed to respond to the request of Aqeel Khan, the judge of the court.

The Election Tribunal inquired as to when is the gazette notification of Anjum Aqeel Khan’s victory, to which Aamir Mughal’s lawyer said that the notification was on February 19, while the Election Commission’s lawyer said that it was on February 13. Aamir Mughal’s petition has been filed out of time.

Justice Tariq Mehmood Jahangiri remarked that he would see according to the law and decide whatever happens. Later, the court adjourned further hearing of the case.
