Islamabad: During the hearing of the full bench of the Supreme Court on the requests of the Sunni Ittehad Council regarding specific seats, Justice Ayesha Malik remarked that seats cannot be given apart from the principle of proportional representation.
A full bench of the Supreme Court, headed by Chief Justice Qazi Faiz Isa, is hearing appeals against the Peshawar High Court’s decision by the Sunni Ittehad Council regarding reserved seats.
At the beginning of the hearing, Faisal Siddiqui, the lawyer of the Sunni Unity Council, inquired that the court asked some questions, should I give arguments now or in response?
Justice Qazi Faiz Isa said that if there are small arguments, give them now. The lawyer said that the affiliation of Chairman Hamid Raza with the Sunni Ittehad Council is shown in the nomination papers. Minorities are also not given membership in Jamiat Ulema-e-Islam (F).
The lawyer Sunni Ittehad Council said that Kanwal Shuzab will be our candidate if certain seats were given, the court had asked for the nomination papers of Sahibzada Hamid Raza, but in the nomination papers, Hamid Raza had shown his affiliation with the Sunni Ittehad Council, not to have non-Muslim members. This clause is also in JUI’s manifesto but still finds specific flaws.
On this, the Chief Justice said that you spoke in the air, you cannot give such a statement, and you gave the documents, Faisal Siddiqui said that I will also give the documents, the Election Commission will also confirm.
On this, Justice Munib inquired whether the party ticket was submitted along with the nomination papers. The lawyer replied that Hamid Raza was being prevented from submitting the party certificate. The Election Commission forcibly allotted the symbol of an independent candidate.
The Chief Justice remarked that Faisal Siddiqui sir, if you had filed the papers, you would not have to ask questions, they would not let you speak without the papers.
Lawyer Faisal Siddiqui said that the record of nomination papers was sought from the Election Commission.
The Election Commission submitted the nomination papers of Chairman Sunni Ittehad Council Hamid Raza, Chief Justice Qazi Faiz Isa directed that copies of Hamid Raza’s nomination papers should be made and given to all the judges.
